These Terms and Conditions constitute a legally binding agreement between you and Scooperdive Ltd governing your access to and use of our game server hosting, network services, and management panel.

Section 01

Agreement & Parties

These Terms and Conditions (“Terms”, “Agreement”) are entered into between Scooperdive Ltd, a private limited company incorporated and registered in England and Wales under Company Registration Number 14606666 (“Scooperdive”, “we”, “us”, or “our”), and the individual or legal entity accessing, subscribing to, or using our services (“Customer”, “Client”, “you”, or “your”).

By registering an account, placing an order, submitting payment, or logging into our game control panel (scooperdive.net) or client billing portal (store.scooperdive.com), you acknowledge that you have read, understood, and agreed to be bound by these Terms, together with our incorporated policies:

Section 02

Account Registration & Security

To access our game server hosting, you must create a client account with accurate, up-to-date, and truthful personal details, including your full legal name, valid email address, and physical address for billing and VAT/tax validation.

You are solely responsible for maintaining the confidentiality and security of your account credentials, passwords, and two-factor authentication (2FA) tokens for both the billing portal and the game control panel. Any actions, configuration modifications, file uploads, or commands executed under your credentials shall be deemed to have been authorized by you.

You agree to notify us immediately via support ticket or email to [email protected] upon discovering any unauthorized access, compromise, or breach of your account.

Section 03

Service Provisioning & Specifications

Upon verification and clearance of your initial payment through our approved payment gateways (Stripe or PayPal), your game server instance will be automatically provisioned on our infrastructure.

Our game servers are deployed on high-performance compute nodes featuring enterprise AMD EPYC™ 9645 processors, PCIe Gen 4/5 NVMe storage arrays, and DDR5 ECC memory located in enterprise datacenter facilities in Manassas, Virginia, USA and Germany (Europe).

Resource allocations (RAM, vCPU cores, storage capacity, database allocations, and backup slots) are governed by the specific tier and configuration selected at checkout. Unmetered bandwidth is subject to reasonable fair use and network integrity standards outlined in our Acceptable Use Policy.

Section 04

Fees, Billing & Renewals

All prices displayed on scooperdive.com and store.scooperdive.com are denominated in British Pounds Sterling (GBP £) unless expressly indicated otherwise. Where applicable, statutory Value Added Tax (VAT) or sales tax is calculated and charged in compliance with local taxation laws.

  • Billing Cycles: Services are billed on a recurring pre-paid subscription basis (monthly, quarterly, semi-annually, or annually). Invoices are generated 7 to 14 days prior to the expiration of the current billing cycle.
  • Payment Methods: We accept credit/debit cards processed securely via Stripe, and PayPal transactions. We do not store raw credit card numbers on our infrastructure.
  • Grace Period & Overdue Invoices:
    • If an invoice remains unpaid on the due date, an overdue reminder is issued.
    • 3-Day Grace Period: You are granted a three (3) day grace period after the due date. On day 4 of non-payment, the server instance is automatically suspended (stopped, with external ports blocked).
    • 7-Day Retention: Suspended server disks and configurations are preserved for seven (7) calendar days following invoice default.
    • Permanent Termination: If payment is not settled within seven (7) days of suspension, the server container and all associated storage volumes, databases, and automated backups are permanently destroyed and released back to the compute pool. Data cannot be recovered once purged.
Section 05

Cancellation & Termination

You may cancel your recurring hosting service at any time through our client portal at store.scooperdive.com. You may choose between:

  1. Immediate Cancellation: The server instance is terminated immediately, and all files are queued for automated deletion.
  2. End of Billing Period: The server remains fully accessible and operational until the expiration of the currently paid cycle, at which point no renewal invoice will be generated.

Scooperdive reserves the right to suspend or terminate your service immediately without prior notice or refund in the event of a material violation of these Terms, including but not limited to violations of our Acceptable Use Policy, fraudulent payments, chargebacks, or abusive behavior directed toward our staff or other customers.

Section 06

Backups & Customer Data

You retain 100% ownership of all game worlds, map saves, configuration files, scripts, and media uploaded to your server instance (“Customer Data”).

Section 07

Third-Party Software, Game Licences & EULAs

Scooperdive provides computing infrastructure and hosting environments. We do not sell or license third-party game software or intellectual property. You must own a legitimate license for the underlying video game (such as Minecraft, FiveM/GTA V, Palworld, Rust, ARK, etc.) and comply with all applicable third-party End User License Agreements (EULAs), including:

  • Mojang / Microsoft: Minecraft Commercial Usage Guidelines and Minecraft EULA.
  • Rockstar Games / Take-Two / Cfx.re: FiveM Platform Service Agreement and Terms.
  • Valve Corporation: Steam Subscriber Agreement for SteamCMD-deployed dedicated servers.
  • Pocketpair, Inc.: Palworld server guidelines.

Any plugins, custom mods, spigot/paper/forge software, or third-party binaries installed on your server instance are run at your own risk. We do not provide warranty or guarantee compatibility for community-created modifications.

Section 08

Acceptable Use

Your use of our infrastructure is strictly governed by our Acceptable Use Policy (AUP). Prohibited activities include, without limitation: outbound denial-of-service (DDoS) attacks, network port scanning, cryptocurrency mining, botnet command-and-control, distribution of malware, hosting copyrighted material without authorization, and any activity violating the laws of the United Kingdom or the United States.

Violations will result in immediate suspension, termination of service, forfeiture of all fees paid, and reporting to relevant legal authorities where appropriate.

Intellectual Property & Trademarks

Scooperdive® is a registered trademark of Scooperdive Ltd registered with the UK Intellectual Property Office. All logos, branding, website design, text, graphics, scripts, and proprietary assets on scooperdive.com and related subdomains are the exclusive property of Scooperdive Ltd.

All other game titles, logos, brand names, and software trademarks referenced on our site (including Minecraft, FiveM, Steam, Palworld, AMD, Intel, Stripe, PayPal) are the property of their respective trademark holders. No sponsorship, affiliation, or endorsement by these entities is claimed or implied.

Section 10

Warranties & Disclaimers

Except as expressly set forth in our Service Level Agreement (SLA), our services, control panels, APIs, and network connections are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express, implied, statutory, or otherwise.

Scooperdive expressly disclaims all implied warranties of merchantability, fitness for a particular purpose, non-infringement, and quiet enjoyment. We do not warrant that our services will be uninterrupted, error-free, immune to third-party cyber attacks, or compatible with every modpack or game update.

Section 11

Limitation of Liability

To the maximum extent permitted by applicable law in England and Wales:

  1. In no event shall Scooperdive Ltd, its directors, officers, employees, or contractors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation damages for loss of profits, goodwill, business interruption, loss of data, or cost of substitute services.
  2. The total aggregate liability of Scooperdive Ltd arising out of or related to these Terms or the services provided shall not exceed the total amount actually paid by you to Scooperdive for the specific service instance in question during the one (1) month immediately preceding the event giving rise to the claim.

Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under UK law.

Section 12

Indemnification

You agree to indemnify, defend, and hold harmless Scooperdive Ltd, its affiliates, directors, officers, and employees from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your breach or alleged breach of these Terms or our Acceptable Use Policy;
  • Any content, mod, script, or data uploaded, transmitted, or stored on your server instance;
  • Any violation of third-party intellectual property, privacy, or contractual rights;
  • Any dispute between you and players, moderators, or users connecting to your game server.
Section 13

Amendments to Terms

We reserve the right to modify or update these Terms at our discretion. When material changes are made, we will update the “Last Updated” date at the top of this document and notify customers via email or an announcement on our official Discord server or client portal.

Your continued access to or use of our services following the posting of revised Terms constitutes your irrevocable acceptance of the modified Terms.

Section 14

Governing Law & Jurisdiction

These Terms, their subject matter, and their formation (and any non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales.

You and Scooperdive Ltd irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute, controversy, or claim arising out of or in connection with these Terms or the services provided.
